In FIR No. 374, dated 31.10.1999, under Section 20 of NDPS

Act, P.S. Kotwali, Faridabad, District Faridabad, vide judgment dated

20.09.2003, trial Court convicted and sentenced the appellant - Gulab Singh,

to undergo RI for a period of 10 years along with fine of Rs.1.00 lakh, and in

default of payment of fine to further undergo RI for a period of 2-1/2 years

more.

Learned State counsel submits that on the basis of copy of the

death certificate dated 02.07.2020, issued by the office of Sub-Registrar

(Birth & Death), MCF FCA, Ballabgarh, which has been handed over to him

by ASI Sandip Singh, appellant - Gulab Singh, has already expired on

14.04.2020. Copy of the death certificate is taken on record, subject to all

just exceptions. Office to tag the same at appropriate place.

Upon the stand taken by leaned State counsel, counsel for the

appellant is unable to dispute the factum of death as submitted by the learned

State counsel with the help of death certificate. JAWALA RAM 2022.12.14 18:15 I attest to the accuracy and authenticity of this order/judgement.

CRA-S-17-SB-2004 (O&M) -2-

In view of said circumstances, present appeal stands abated, and

same is disposed of as such. However, disposal of the present appeal will be

subject to the terms & conditions, passed by this Court in IOIN-CRA-S-

4686-SB-2018 in CRA-S-4686-SB-2018, titled as, "Shivji Ram @ Dimple

Vs. State of Punjab", decided on 24.11.2022.

Pending criminal miscellaneous application(s) are also disposed of,

accordingly.
