VIKAS BAHL, J.(ORAL) Challenge in the present appeal is to the judgment and order dated 19.09.2018 vide which the appellant along with other accused have been convicted and sentenced as under:-
Names of Offence(s) Imprisonment awarded Sentence in default of convicts- Under section(s) payment of fine accused Jeetu alias 379-A read with Rigorous imprisonment for Rigorous imprisonment Jitender and Section 34 IPC a period of five years along for a period of six Parma @ with fine of Rs.25,000/- months each.
Parshant each.
506 read with Rigorous imprisonment for Rigorous imprisonment Section 34 of a period of six months along for a period of one IPC with fine of Rs.500/- each. month each. Both the above mentioned sentences shall, however, concurrently."
Learned counsel for the appellant has submitted that since the appellant has already undergone 5 years and 7 months of total sentence and therefore, has undergone the period of 6 months also which was the sentence awarded in default of payment of fine, thus, she wishes to withdraw the present appeal.
In view of the same, the present appeal is dismissed as withdrawn.
