The petitioner has preferred the instant petition under Section 438 Cr.P.C., for grant of anticipatory bail in case FIR No.28 dated 26.04.2022, registered under Sections 406, 498-A IPC at Police Station Kheri Gandian, District Patiala.
Learned State counsel, on instructions from Inspector Hardeep Singh, has stated that the petitioner has joined investigation. He states that, however, certain dowry articles remain to be recovered.
The non-recovery of dowry arcticles, in the considered opinion of this Court would not be a ground to deny the relief of anticipatory bail to the petitioner. The Investigating Agency had sufficient opportunity to recover the same during the course of investigation and at the time when the petitioner joined investigation.
Considering the fact that the petitioner has joined investigation, the order dated 26.05.2022 is made absolute subject to the conditions as envisaged under Section 438(2) Cr.P.C.
Petition stands disposed of, accordingly.
