Instant petition has been filed under Section 482 of Cr.P.C. for
issuance of a direction to respondents No.1 to 3 to initiate legal action against
respondents No.4 to 6 for committing cheating with the petitioner and for
defaming her by levelling false allegations regarding her character by
respondent No.4 in inquiry report.
Complaint, Annexure P-1, submitted by the petitioner has been
enquired into and a recommendation, Annexure P-3, has been made. By way of
present petition, petitioner seeks to re-open the enquiry and has requested that
the matter be referred to a senior official.
In view of the judgment of the Supreme Court as Sakiri Vasu
Versus State of U.P. and others, 2008 (1) R.C.R. (Criminal) 392, petition
under Section 482 of Cr.P.C. is not maintainable. Petitioner, however, has
remedy under Section 156 (3), Cr.P.C., which she is at liberty to avail.
Petition is disposed of.
