The instant petition has been filed under Section 482 Cr.P.C. for

setting aside the order dated 25.03.2022 (Annexure P-5) passed by learned

Additional Sessions Judge, Karnal whereby, the petitioner was declared a

proclaimed offender in CRA-776-2019 titled as Amanjeet Singh Vs.

Indusind Bank Ltd..

Learned counsel for the petitioner contends due to COVID-19

situation, the petitioner could not appear before the lower Appellate Court

and the said absence is neither intentional nor deliberate. Moreover, the

petitioner has been thoroughly represented in the trial till the passing of the

judgment without any default. He further submits that petitioner is ready

and willing to deposit 20% of the compensation amount, as ordered by the

lower Appellate Court.

On the asking of Court, Mr. Chetan Sharma, AAG, Haryana

accepts notice on behalf of respondent-State and submits that the petitioner

is absenting since 06.03.2020 and finally declared proclaimed offender on

25.03.2022, which is under challenge before this Court.

Be that as it may, to meet the ends of justice and in the light of

the fact that no prejudice would be caused to either of the parties involved in

the present dispute, it would be apetite to grant one opportunity to the

petitioner to appear before the lower Appellate Court.

In view of above, the petitioner is directed to surrender before

the trial Court within 15 days from today and apply for regular bail.

In case, such an application for bail is moved by the petitioner

before the trial Court, the same shall be considered and decided on the same

date in accordance with law.

The present petition stands disposed of accordingly.
