VIVEK PURI, J. (ORAL)

The petitioners have assailed the order dated 14.01.2020,

Annexure P-7 passed by the Court of learned Addl. Sessions Judge, Jind. At

the instance of respondent No.2 the case bearing FIR No. 110 dated

29.06.2017 under Sections 498-A, 406, 506 & 34 IPC (Sections 506 & 34

IPC deleted later on) has been registered at Women Police Station. Jind.

After the investigation, the challan has been presented only against Naresh

Sharma, the husband of respondent No.2. The petitioner Nos. 1, 2 and 3 are

the father, mother and sister of Naresh Sharma. The respondent

No.2/complainant had moved an application under Section 319 Cr.P.C. in

the trial Court for summoning the petitioner. The application was dismissed

by the trial Court in terms of order dated 29.08.2019. However, the

respondent No.2/complainant preferred a revision petition and the same has

been allowed in terms of judgment dated 14.01.2020 passed by the Court of

learned Addl. Sessions Judge, Jind. The learned trial Court has been

directed to pass fresh order after taking into consideration the complaint and

testimony of the witnesses.

Learned counsel for the petitioners contend that matrimonial

dispute has been amicably settled. The complainant/respondent No. 2 has

withdrawn the application under Section 319 Cr.P.C. Even the aforesaid FIR

has also been quashed in terms of order of even date passed in CRM-M-

infructuous.

Dismissed as having been rendered infructuous.
