The Court has been convened through video conferencing due to

Covid-19 pandemic.

Instant petition has been filed under Section 438 of the Code of

Criminal Procedure, 1973 for grant of anticipatory bail in case FIR

No.130 dated 19.09.2015 under Section 15 of the Narcotic Drugs and

Psychotropic Substances Act, 1985, registered at Police Station Sangat,

District Bathinda (Annexure P-1).

Counsel for the petitioners has been heard.

In view of the judgment passed in CRM-M-15464-2019 titled as

"Balwant Singh @ Banta versus State of Punjab" dated 04.04.2019, the

petition is not maintainable.

Counsel for the petitioners submits that the petitioners, who were

granted regular bail, vide order dated 19.10.2015 (Annexure P-2), were

continuously appearing before the trial Court till March, 2020, but could

not appear thereafter due to the outbreak of the pandemic. He submits that

the petitioners will surrender before the trial Court within a period of one

week from today and file a petition for regular bail, which may be ordered

to be decided expeditiously.

I have considered the request of the counsel.

In case, the petitioners surrender before the trial Court within a

period of one week from today and file a petition seeking bail pending trial,

the trial Court shall make an endeavour and decide the same, preferably, on

the day it is filed.

Disposed of.
