Petitioners have assailed the order dated 23.05.2019

passed by the Civil Judge (Jr. Divn.) Mukerian vide which the

application under Section 10 read with Section 151 CPC was

dismissed.

Mr. Surender Mohan Sharma, Advocate appears on

behalf of respondent No.1 and submits that the suit itself has

been decided by the trial Court vide judgment and decree dated

30.09.2019 and, therefore, this revision petition has become

infructuous.

In view of aforesaid status of the suit, this petition is

dismissed as having become infructuous. However, it is made

clear that if statement of fact made by learned counsel for

respondent No.1 is found to be incorrect, then in such

eventuality, learned counsel for the petitioners would be at

liberty to move an appropriate application for revival of the

present petition.
