ANIL KSHETARPAL, J (Oral) The hearing of the case was held through video conferencing on
account of restricted functioning of the Courts.
The judgment debtors assail the correctness of the order passed
by the Civil Judge (Jr. Div.), Charkhi Dadri, while dismissing the objections
filed in the execution petition. The petitioners claim that since consolidation
proceedings are pending, therefore, the decree of possession cannot be
executed.
Learned counsel representing the respondent has pointed out that
the consolidation proceedings have already been quashed vide order dated
22.12.2020 by the Commissioner of the Division.
Learned counsel representing the petitioners does not dispute
this fact. However, he submits that further proceedings are pending.
Be that as it may, as of today, there are no consolidation
proceedings. In view thereof, there is no ground to interfere in the order
passed by the executing Court.
Dismissed.
All the pending miscellaneous application(s), if any, are also
disposed of.
