ORAL JUDGMENT
Date : 03-12-2025 Heard the parties.
2. The petitioner college, represented through its
Chairman, has approached this Court seeking a direction upon
the concerned respondents to accord affiliation and recognition
to the petitioner college to impart Bachelor of Arts and Bachelor
of Science courses for academic session 2025-29 and onwards.
3. Learned Advocate for the petitioner submitted that
despite the recommendation having been made in favour of the
petitioner college in pursuance of the inspection report as well
as by the Syndicate of the University, the matter is pending
before the Education Department, Government of Bihar and till
date no action has been taken. Referring to the averments made Patna High Court CWJC No.17734 of 2025 dt.03-12-2025
in the writ petition, learned Advocate would further submit that
initially some shortcomings were noticed by the Department of
Higher Education, Government of Bihar, however, the same has
also been removed and finally the University vide its letter No.
3401-Est.-I dated 10.09.2025 (Annexure-P/5) has made a
recommendation in favour of the petitioner college for
affiliation, but no action has been taken. However, in the
meantime, with respect to similar colleges, final decision has
been taken and affiliation has been done; to support the
aforesaid contention, Annexure-P/6 has been brought on record.
4. On the other hand, learned Advocate for the State
prays for a short adjournment in order to get instruction and file
counter counter affidavit.
5. Having considered the limited grievance of the
petitioner, this Court deems it fit and proper to dispose of the
writ petition with a direction to the respondent No. 2 to look
into the claim of the petitioner for affiliation of the college in
terms with the recommendation made by the concerned
University, as contained in Annexure-5 to the writ petition, and
take appropriate decision, preferably within a period of six
weeks from the date of receipt/production of a copy of this
order.

6. The writ petition stands disposed of.
