Heard Mr. Sunil Kumar Karn, learned counsel
appearing on behalf of the petitioner; Mr. Sanjay Prasad learned
AC to AAG 4 for the State and Mrs. Nivedita Nirvikar learned
senior counsel for the Accountant General, Bihar.
2. Learned counsel appearing on behalf of
petitioners submits that petitioners seek to file a detailed
representation for redressal of their grievance before the
Engineer-in-Chief, Irrigation Department, Government of Bihar,
Patna in light of order passed by a Division Bench of this Court
in LPA No.198 of 2016 (The Registrar General, Patna High
Court Versus Ram Vyas Dubey & Ors.) as well as the
decision rendered by the Apex Court in the case of Maheshwar
Pandey Vs. State of Bihar and Ors. reported in [2023 SCC
Online SC 527].
3. Considering the aforesaid specific submission
made on behalf of petitioners, Engineer-in-Chief, Irrigation
Department, Government of Bihar, Patna is directed to consider
the representation/s of the petitioners of the present writ petition
and call for their service particulars from the date they were
engaged as daily wagers and take final decision in light of the
Patna High Court CWJC No.9986 of 2023 dt.13-10-2023
decisions rendered in The Registrar General, Patna High
Court (Supra) and Maheshwar Pandey (Supra) within a
period of three months from the date of filing of such
representation/s by the petitioners.
4. With aforesaid observation and direction, the
writ petition is disposed of.
