Heard learned counsel for the parties.
2. State counsel accepts notice for Respondent Nos. 1 to
9.
3. Service of notice to 10th Respondent is dispensed.

4. In the instant petition, petitioner has prayed for the
following relief/reliefs:
"(i) For issuance of Writ in appropriate nature for setting
aside the selection of the Respondent No. - 10 on the Post of
Aanganbari Sevika for Anganbari Centre No. - 341 situated
under Ward No. - 12 at Gram Panchayat Raj Manguraha
Tajpur situated at Village - Kaithaulia, P.O. - Birhma Bazar,
P.S. - Baruraj, Block - Motipur, District- Muzaffarpur.
(ii) For issuance of Writ in appropriate nature for direction
upon Respondent authorities to convene meeting of the Aam
Sabha / General Meeting for the selection on the Post of
Aanganbari Sevika for Anganbari Centre No. - 341 situated
under Ward No. - 12 at Gram Panchayat Raj Manguraha
Tajpur situated at Village - Kaithaulia, P.O. - Birihma Bazar,
P.S. - Baruraj, Block - Motipur, District- Muzaffarpur.
(iii) Any other relief/reliefs that the Petitioner may be
found to be entitled to in the facts and circumstances of the
present case."
5. Matter relates to selection and appointment to the post
of Aanganbari Sevika for Anganbari Centre No. - 341 situated
under Ward No. - 12 at Gram Panchayat Raj Manguraha Tajpur
situated at Village - Kaithaulia, P.O. - Birhma Bazar, P.S. -
Baruraj, Block - Motipur, District- Muzaffarpur. The petitioner's
appeal against non selection and selection of 10th Respondent is
pending consideration before the 4th Respondent, The Divisional
Commissioner, Tirhut Division, Muzaffarpur. He is hereby
directed to decided the petitioner's appeal in accordance with law
after giving due opportunity of hearing to the petitioner and 10 th
Respondent and decide the petitioner's appeal within a period of
three months from the date of receipt of this order.

With the above observations, writ petition stands
disposed off.
