Heard Mr. Shailendra Kumar Jha, the learned

Advocate for the petitioner and Mr. Upendra Pratap Singh,

the learned counsel for the State.

2. Since the petitioner has not availed of the

appellate remedy, we are not inclined to entertain this

petition.

3. The petition is disposed off, but with an Patna High Court CWJC No.8681 of 2022 dt.12-08-2022

observation that in case an appeal is filed before the

appropriate authority, it shall be taken up for

consideration and after giving reasonable time to the

petitioner to represent his cause, a final order shall be

passed as far as possible within a period of sixty (60)

days from the date of receipt/production of a copy of this

order. The order so passed by the appellate authority

shall contain reasons in support of the same.

4. The order passed by the appellate authority

shall be made available to the petitioner forthwith.

5. The petition stands disposed off

accordingly.
