01. This matter is taken up through hybrid mode.

2. Heard Mr. Mohanty, learned Counsel for the Petitioner so also Mr. S. Mishra, learned Additional Standing Counsel for the State, who accepts notice on behalf of the Opposite Party Nos.1 & 2 and admits to have received copy of the writ petition.

3. An innocuous prayer has been made in the writ petition for early disposal of Mutation Appeal No.45 of 2021 allegedly pending before the Sub-Collector, Sadar, Cuttack (Opposite Party No.1).

4. That apart, it has been averred in the writ petition that after filing of the said appeal before the Opposite Party No.1, only notices were issued to the Respondents. Thereafter, the case has not yet been heard by the Sub- Collector, Sadar, Cuttack on the plea that the LCR is yet to

be received from the Office of the Tahasildar, Sadar, Cuttack (Opposite Party No.2).

5. Hence, on consent of the learned Counsel for the parties, without expressing any opinion regarding the merits of the mutation appeal, the writ petition stands disposed of at the stage of admission, directing the Sub- Collector, Sadar, Cuttack (Opposite Party No.1) to proceed further in Mutation Appeal No.45 of 2021 in accordance with law and conclude the said proceeding at the earliest, preferably within a period of six months from the date of production of certified copy of this order, provided there is no legal impediment.

6. It is made clear that the appellate authority shall give an opportunity of hearing to the parties, including the private Opposite Party Nos. 3 to 5 to the present writ petition, who are said to be Respondents in Mutation Appeal No.45 of 2021, while disposing of the said appeal.
