  02.       1.       Heard.

2. By judgment dated 24.12.2025 of the learned Special Judge (Vigilance), Angul in T.R. Case No. 50 of 2011 the appellant-petitioner has been convicted for commission of offences under Sections 13(2), 13(1)(d) read with Section 7 of the Prevention of Corruption Act, 1988 and sentenced to undergo Rigorous Imprisonment for 2 (two) years and to pay a fine of Rs. 10,000/- in default to undergo further R.I. for 3 (three) months for the offence under Section 13(2) read with Sections 13(1) (d) of the P.C. Act, 1988 and to undergo R.I. for one year and to pay a fine of Rs. 10,000/- in default to undergo further R.I. for 3(three) months for the offence under Section 7 of the Prevention of Corruption Act. Both the sentences are to run concurrently.

4. Call for the scanned copy of the Trial Court Records.

5. List this case on 06.04.2026.

6. Mr. Sanjay Kumar Das, learned Standing Counsel (Vigilance) submits that he shall file appearance memo by 22.01.2026.

7. This is an application under Section 415(2) of BNSS for grant of bail during pendency of the appeal.

8. Learned counsel for the appellant-petitioner submits that the petitioner was on bail during trial and he has not misutilised his liberty.

9. Considering the sentence imposed and that the appellant- petitioner was on bail during trial, I am inclined to allow the I.A.

10. The Appellant- Pabitra Mohan Nayak on surrendering before the learned trial Court within four weeks from today, shall be released on bail, pending disposal of the Criminal Appeal, on such terms and conditions as may be fixed by the learned trial Court.

11. This I.A. is disposed of.

12. This I.A. has been filed for staying realization of fine amount.

13. The appellant-petitioner shall deposit the fine amount in the learned trial Court within a period of four weeks from today. Such deposit shall be subject to result of the appeal.

14. This I.A. is disposed of.

15. Urgent certified copy of this order be granted on proper application.
