09. 1. Heard Mr. I. Sahoo, learned counsel for the Petitioners and
Mr. U.R. Jena, learned Additional Government Advocate for the
contemnors.
2. It seen that a purported compliance affidavit dated 12.03.2026
(16.03.2026) has been filed by the present Secretary to
Government in Water Resources Department, namely, Smt.
Subha Sharma. Paragraphs 6 & 7 of the said affidavit reads as
follows:-
"6. That, it is humbly submitted that, pursuant to the
direction of this Hon'ble Court vide order dated
12.03.2026 were communicated by the Additional
Secretary to Government, Water Resources Department
to the E.I.C., Water Resources, Odisha, Bhubaneswar
requesting therein for implementation of the above
orders of the Hon'ble Court. Thus the order of the
Hon'ble High Court has been complied with.
Copy of the letters are annexed as Annexure A/2 series.
7. That, it is humbly submitted that since the order dated
30.01.2026 passed in this present contempt case has

already been complied with, this deponent humbly
submits before the Hon'ble High Court with a prayer to
drop the contempt proceeding. Further, this Hon'ble
Court may graciously be pleased to dispense with the
personal appearance of the deponent."
3. It is submitted on behalf of the Petitioners that pensionary
benefits have not been received by the Petitioners till date,
pursuant to the direction of this Court and confirmed by Hon'ble
Apex Court.
4. Mr. Jena, learned A.G.A. also admits that the order of this
Court is to be complied with fully yet.
5. In view of the statements made at paragraphs 6 & 7 stated
above, which are found to be misleading, the deponent, namely,
Smt. Subha Sharma, presently working as Principal Secretary to
Government, Water Resources Department is directed to appear
in person before this Court on 14th May 2026 at 2.00 P.M.
6. List all these matters on 14th May, 2026, at 2.00 P.M.
