I.A. No.955 of 2025 Order No.

01. 1. Heard Mr. Mohanta, learned counsel for the petitioner.

2. Instant petition is filed under Section 5 of the Limitation Act for delay condonation.

3. It is submitted to the Court by Mr. Mohanta, learned counsel for the petitioner that the petitioner could not file the revision in time, hence, him having been convicted and sentenced and the same stood confirmed in appeal, the delay which has occasioned thereby should be condoned in the interest of justice. Accepting the explanation offered and recording submission Mr. Mohanta, learned counsel for the petitioner, the Court is in favour of condoning the delay.

4. Accordingly, it is ordered.

5. In the result, IA stands allowed condoning the delay of 45 days in filing of the revision.

2. Instant revision is filed by the petitioner assailing the impugned judgment at Annexure-3.

3. The petitioner has been convicted for an offence under Section 138 of the NI Act and directed to undergo sentence of SI of six months and compensation of Rs.1,55,482/-. Considering the facts pleaded on record and grounds stated, the Court is inclined to issue notice to opposite party for a reply and response.

4. Hence, it is ordered.

5. Notice to opposite party by way of Speed Post with AD returnable at an early date and for the said purpose, Mr. Mohanta, learned counsel for the petitioner shall file the requisites within seven days.

6. List on 29th October, 2025 for final orders.

1. Heard.

2. Instant petition is filed for interim orders.

3. As an interim measure, this Court stays realization of the compensation and sentence till disposal of the revision subject to deposit of Rs.10,000/- before the learned court below. It is further directed that in the event, the above order is complied with, there shall be no coercive action against the petitioner in connection 1CC Case No.125 of 2018.

4. List on the date fixed for further orders.

5. Issue urgent certified copy of this order as per rules.
