01. 1. Heard Mr. Satapathy, learned counsel for the petitioner.
2. Instant writ petition is filed by the petitioner challenging the impugned judgment at Annexure-1 confirming the decision of the learned Civil Judge, Jr. Division, Hemgiri in Election Petition No. 01 of 2022 dated 10th August, 2023 on the grounds stated.
3. Considering the plea advanced and as the margin of vote is only one and recounting was demanded and it was not allowed for having not been moved at the earliest point in time and such a decision of the learned Tribunal stood confirmed vide Annexure-1, the Court is inclined to issue notice to the opposite parties for a reply and response.
4. Hence, it is ordered.
5. Notice.
6. Mr. Ray, learned AGA for the State accepts notice for opposite party Nos.2 and 3.
7. Issue notice to opposite party No.1 by Speed Post making it returnable at an early date and for the said purpose, the requisites shall be filed by Mr. Satapathy, learned counsel for the petitioner within seven days from today.
8. List on 29th October, 2025 for final hearing and orders.
