01. 1. Heard learned counsel for the Petitioner and learned counsel for the State.

2. The Petitioner is seeking pre-arrest bail in connection with Mangalabag P.S. Case No.300 of 2025 pending on the file of learned Court in seisin for commission of offences punishable under Section 303(2) of BNS, 2023.

3. It is submitted by the learned counsel for the Petitioner that because of the dissention with the Informant there is likelihood of the Petitioner to be cited as an accused. Hence, the Petitioner may be protected by pre-arrest bail.

4. Learned counsel for the State opposes the prayer.

5. Judging the background in which the submission is made, this Court is persuaded to hold, keeping in view the judgment of the Apex Court in the case of Gurbaksh Singh Sibbia & Others Vrs. State of Punjab, reported in (1980) 2 SCC 565 that the apprehension of the Petitioner is not fanciful.

6. Considering the nature of allegations, it is directed that in the event of arrest of the Petitioner in connection with the aforesaid case, he shall be released on bail by the Arresting Officer on such terms and conditions deemed just and proper with further conditions that he will cooperate with the investigation.

7. Violation of any of the above condition(s) shall entail cancellation of bail.

8. Accordingly, the ABLAPL stands disposed of.

9. Urgent certified copy of this order be granted as per rules.
