04. 1. Heard Mr.Nanda, learned counsel for the Petitioner and Mr.Satapathy, learned counsel for the Opposite Party.

2. Present CMP is directed against order dated 7th April 2025 passed in Execution Proceeding No.1 of 2015 pending in the Court of learned Civil Judge (Junior Division), Similiguda, Koraput.

3. In course of hearing, it is admitted at the Bar that CMA No.3 of 2024, arising out of RFA No.3 of 2014, is pending in the Court of learned Additional District Judge, Koraput against the impugned judgment and decree of the learned trial court. Accordingly, it is felt appropriate to direct the First Appellate Court for early disposal of CMA No.3 of 2024 filed under Order 41 Rule 19, CPC.

4. Accordingly, present CMP is disposed of with a direction to the learned First Appellate Court to dispose of CMA No.3 of 2024 (arising out of RFA No.3 of 2014), in accordance with law,
