01. 1. Heard Mr. Tripathy, learned counsel for the petitioner.

2. Instant revision is filed by the petitioner challenging the impugned judgment in Criminal Appeal No.74 of 2024 at Annexure-1 of the learned 1st Additional District & Sessions Judge, Berhampur, Ganjam confirming the judgment in I.C.C. Case No.500 of 2022 of the learned J.M.F.C. (Transport), Berhampur on the grounds stated.

3. For the facts pleaded on record and the submission of Mr. Tripathy, learned counsel for the petitioner, the Court is inclined to issue notice to the opposite party.

4. Hence, it is ordered.

5. Notice to the opposite party by Speed Post with a short returnable date and for the said purpose, requisites shall be filed

by Mr. Tripathy, learned counsel for the petitioner within seven days from today.

6. List on 17th December, 2025 for final hearing and orders.

02. 1. Heard.

2. Instant I.As. are filed seeking release of the petitioner on bail and to stay realization of fine imposed and confirmed in appeal.

3. Referring to Annexure-3 series, a copy of the order dated 19th December, 2024 in Criminal Appeal No.74 of the learned Court below, it is submitted that 20% of the compensation amount has been deposited by the petitioner, hence, therefore, she should be allowed to go on bail with conditions and further directing stay realization of fine amount till disposal of the revision.

4. Considering the statutory deposit being made by the petitioner, so revealed from Annexure-3 series, this Court, as an interim measure, awaiting appearance of the opposite party, directs release of the petitioner on bail in I.C.C. Case No.500 of 2022 subject to suitable conditions imposed by the learned J.M.F.C.(Transport), Berhampur staying realization of fine amount till the next date of hearing.

5. List on the date fixed for further orders.

6. Issue urgent certified copy as per rules.
