1. This matter is taken up through hybrid mode.
2. Heard learned counsel for the Petitioner and learned counsel appearing for the Opp. Parties.
3. Petitioner has filed the present writ petition inter alia with the following prayer:-
"It is, therefore, prayed that this Hon'ble Court may graciously be pleased to issue notice to the opp parties calling upon them to file show cause as to why
(i) a direction shall not be issued to regularize the service of the petitioner against the post of driver at least with effect from 1.6.2017, taking into consideration the G.A. under Department resolution dated 17.09.2013 Annexure -4 as well as the recommendation of opp.party no.3 dated 18.12.2013 to opp.party no.2 and judgment of Hon'ble Apex Court of India rendered in between Amarkanti Rav Versus State of Bihar and others reported in (2015) 8 SCC 265, Jaggo Versus Union of India in SLP No.5580/2024 and Anita and others Versus Union of India in SLP No. 11086/24 dated 20.12.2024 and Sripal and
another Versus Nagar Nigam Gaziabad in Civil Appeal No.8157 of 2024 dated 31.01.2025
(ii) And after hearing the parties be pleased to direct the opp.parties to regularize the service of the petitioner against the post of driver w.e.f. 1.6.2017 with all service and financial benefits.
(iii) The opp.parties be directed to sanction and release differential arrears of the petitioner with effect from 1.6.2017 to till date; within a date to be fixed by this Hon'ble Court.
(iv) And pass any other order/orders, direction/directions as this Hon'ble Court may deem fit and proper.
And for this act of kindness the petitioner shall as in duty bound ever pray."
4. However, taking into account the claim raised in the present Writ Petition, liberty is granted to the Petitioner to make a fresh representation before Opp. Party No.2 by enclosing all the relevant documents and citations in support of his claim, if any, within a period of three (3) weeks hence.
5. It is observed that if such representation is filed within the aforesaid time period, Opp. Party No. 2 shall do well to take a lawful decision on the same within a period of three (3) months from the date of receipt of such representation. The order so passed by Opp. Party No. 2 be communicated to the Petitioner.
6. With the aforesaid observation and direction, the Writ Petition is disposed of.
