4. Considering the submissions and the grounds raised, the second appeal is admitted on the following substantial question of law.
"Whether the first appellate court was correct in dismissing the appeal on the ground of limitation on sheer technicalities and without considering the sufficiency of the reasons cited by the appellant to explain the delay."
5. Issue notice to the respondents by registered Post with A.D. making it returnable within four weeks. Requisites be filed within three days.
