03. This matter is taken up through Hybrid arrangement (video conferencing/physical mode).

Heard learned counsel for the petitioner and learned counsel for the opposite parties.

This writ petition has been filed by the petitioner Jhunu Behera with a prayer to quash the order dated 30.04.2024 passed by the learned Central Administrative Tribunal, Cuttack Bench, Cuttack, in O.A. No.960 of 2016 under Annexure-20.

Learned counsel for the petitioner points out from the impugned judgment regarding the prayer that was made by the petitioner in the original application, which is quoted in paragraph no.1 of the impugned judgment. Learned counsel submits that neither the learned Tribunal

has discussed anything whether the petitioner is entitled to get such relief or not nor rejected the prayer, but has given inconsequential relief, which was not prayed for by the petitioner. Learned counsel further submits that since the Tribunal has not adverted to the merits of the case and decided the entitlement of the petitioner to relief as prayed for, it is a fit case for remand to the learned Central Administrative Tribunal, Cuttack Bench, Cuttack for fresh adjudication in accordance with law.

Issue notice on the question of admission indicating therein that the matter shall be disposed of at the stage of admission.

Mr. Bhabani Shankar Rayaguru, learned Senior Panel Counsel has already entered appearance for all the opposite parties and seeks three weeks' time to file counter affidavit.

List this matter on 14.07.2025. Counter affidavit, if any, be filed in the meantime.
