06. 1. There shall be stay realization of fine amount as imposed in judgment dated 12th December, 2023 passed in C.T. (SS) Case No.118 of 2016 till disposal of the appeal.

2. The I.A. is disposed of.

07. 3. Heard Mr. S.K. Dash, learned counsel for the Appellant -

Petitioner and Mr. R. Pradhan, learned Additional P.P. for State - Respondent - Opposite Party.

4. The Appellant, namely Sumana Naik who has been convicted for commission of offence under Section 304 Part-I of I.P.C. and sentenced to undergo R.I. for 10 years along with fine by the learned Addl. Sessions Judge, Dhenkanal in his judgment dated 12th December, 2023 passed in C.T.(SS) Case No.118 of 2016 has prayed to release him on bail pending appeal.

5. It is submitted that the appellant is inside custody since 12th December, 2023 upon his conviction and prior to that was detained for the period from 20th February, 2016 to 29th August, 2017.

6. Upon hearing both parties and considering the statement of the witnesses including eye witness, viz. P.W.7 and P.W.13 and the circumstances, it is directed to release the Petitioner - Appellant on bail pending appeal on such terms and conditions to be fixed by the learned Addl. Sessions Judge, Dhenkanal in C.T.(SS) Case No.118 of 2016 including the condition that the Appellant shall furnish two sureties (with identity proof) out of which one shall be his relative.

7. The I.A. is disposed of.

08. 8. List the appeal for hearing in the last week of November, 2025.

9. An urgent certified copy of this order shall be issued on proper application.
