04. 1. There shall be stay realization of fine amount as imposed in judgment dated 21st January, 2025 passed in G.R. Case No.08 of 2023 till disposal of the appeal.

2. The I.A. is disposed of.

05. 3. Heard Mr. A. Mishra, learned counsel for the Appellant -

Petitioner, Mr. S.K. Rout, learned Additional P.P. for State - Respondent - Opposite Party as well as Mr. K.C. Behera, learned counsel for the informant.

4. The Appellant, namely Bhanja @ Bhanja Kishore Nayak, who has been convicted for commission of offences under Section 354/506/341 of the Indian Penal Code along with Section 10 of the POCSO Act and sentenced to undergo R.I. for six years along with fine by the learned Ad hoc Additional Sessions Judge (FTSC),

Kendrapara in his judgment dated 21st January, 2025 has prayed to release him on bail pending appeal.

5. It is submitted that the Appellant is inside custody since 22nd January, 2025 upon his conviction and prior to that he was in custody for a period of 3 months and 10 days.

6. Upon hearing all the parties and considering the evidence of the minor victim (P.W.3) and other witnesses I am not inclined to release the Appellant on bail at this stage. Accordingly the prayer for bail is rejected.

7. The I.A. is dismissed.

06. 8. List the appeal for hearing on 3rd November, 2025.

9. An urgent certified copy of this order shall be issued on proper application.
