27.01.2025 Order No. WP(C) no.29935 of 2024 and I.A. no.15907 of 2024

01.

1. Mr. Dalai, learned advocate appears on behalf of

petitioner and submits, his client had challenged work order

dated 6th November, 2024 issued during pendency of his client's

writ petition, subject matter of which was the tender. He refers

to extracts of quotations of several orders made by coordinate

Bench ending with order dated 20th August, 2024. He

demonstrates there was record of hearing concluded and the

writ petition reserved for judgment.

2. Mr. Tripathy, learned Advocate, Additional

Government Advocate appears on behalf of State. He submits,

there was no interim order of restraint. That does not answer

why the work order was not issued during course of hearing of

the writ petition and even long after judgment was reserved. On

further query, we are told that the writ petition was

subsequently released immediately prior to the presiding

learned Judge demitting office.

3. Issue notice along with this order on opposite party no.8

by registered/speed post with A.D. Petitioner will put in

requisites.

4. List on 17th February, 2025 along with W.P.(C) no.6961

of 2024. Impugned work order dated 6th November, 2024 will

remain stayed till next date of hearing.
