1. This matter is taken up through hybrid mode.
2. Heard learned counsel for the Petitioner and learned counsel appearing for the Opp. Parties.
3. Petitioner has filed the present writ petition inter alia with the following prayer:-
"Under the above circumstances, it is humbly prayed that the writ petition may be allowed;
And
(A) a writ of mandamus or an appropriate writ may be issued quashing the impugned order of dismissal dated 21.08.2017 passed by the District Education Officer, Keonjhar under Annexure:3 and necessary direction may be made to the opposite parties to reinstate the petitioner in his former post with all consequential service and financial benefits as he has been honorably acquitted in the criminal case i.e. in Spl.
Case No.291/80 of 2022-2017 (T.C. No.14 of 2023) arising out of Joda P.S. Case No.86 of 2017 by virtue of judgment and order dated 29.06.2024 passed by the learned Ad hoc Addl. District and Sessions Judge (FTSC), Keonjhar under Annexure:4 and no Disciplinary
Proceeding was initiated against him, keeping in view the judgment of the Hon'ble Apex Court rendered in the case of Ram Lal Vs. State of Rajasthan and others (Civil Appeal No.7935 of 2023 arising out of SLP (C) No.33423 of 2018 disposed of on 04.12.2023), within a time to be stipulated by this Hon'ble Court; B) And or any other order /orders direction / directions may be issued so as to give complete relief to the petitioner;
And for this act of kindness, the petitioner shall as in duty bound remain ever pray."
4. However, taking into account the claim raised in the present Writ Petition, liberty is granted to the Petitioner to make a fresh representation before Opp. Party No. 3 by enclosing all the relevant documents and citations in support of his claim, if any, within a period of three (3) weeks hence.
5. It is observed that if such representation is filed within the aforesaid time period, Opp. Party No. 3 shall do well to take a lawful decision on the same within a period of three (3) months from the date of receipt of such representation. The order so passed by Opp. Party No. 3 be communicated to the Petitioner.
6. With the aforesaid observation and direction, the Writ Petition is disposed of.
