04.02.2025

M.C. No.66 of 2017 and CRLLP No. 66 of 2017 Order No.

02. 1. This matter is taken up through hybrid mode.

2. Heard Mr. Tripathy, learned AGA for the State.

3. Present leave petition has been filed with delay of 435 days.

4. Having gone through the limitation petition, no substantial ground is seen in the same to condone such huge delay. It is only stated that after the judgment was send by the Public Prosecutor, the same was processed through the Advocate General and consequently present application has been filed. In other words, the delay has not been explained satisfactorily to be condoned nor it is explained in detail.

Location: High Court of Orissa, Cuttack

5. As such, we are not inclined to condone the delay and the limitation petition is dismissed. Consequently, the CRLLP is also dismissed on the ground of limitation.
