1. This matter is taken up through hybrid mode.

2. Heard learned counsel appearing for the Parties.

3. The present Writ Petition is filed inter alia challenging the resolution dated 25.09.2024 so issued by Opp. Party No.1 under Annexure-2.

4. It is the main contention of the learned counsel appearing for the Petitioner that such a resolution, more particularly the stipulation contained in Para-6 is contrary to the judgment delivered by this Court on 09.08.2024 in W.P.(C) No. 21977 of 2014. It is accordingly contended that on the face of the judgment so passed, stipulation contained in Para-6 of resolution could not have been included.

5. Learned Addl. Standing Counsel on the other hand contended that if Petitioner is aggrieved by the stipulation contained in Para-6 and it is the contention that the same is contrary to the judgment dated 09.08.2024 so passed in W.P.(C) No. 21977 of 2014, let the Petitioner apprise the said fact before Opp. Party No.1 for consideration.

6. Having heard learned counsel for the Parties and considering the submission made, this Court while disposing the Writ Petition, permits the Petitioner to move Opp. Party No.1, so far as stipulation contained in Para-6 of the resolution is concerned, within a period of 3 (three) weeks hence.

7. It is observed that if such application is filed within the aforesaid time period, Opp. Party No. 1 shall do well to take a lawful decision on the same within a period of three (3) months from the date of receipt of such representation. Relevancy and effect of the Judgment available under Annexure-4 be taken into consideration, if it is applicable.

8. With the aforesaid observation and direction, the Writ Petition is disposed of. Petitioner is directed to provide a copy of the order along with the judgment available at Annexure-4 before Opp. Party No.1 for compliance.
