02. 1. A preliminary objection is raised on the maintainability of the writ petition after the expiration of the statutory period of appeal provided in the statute. The reliance is placed upon the judgment of the Apex Court rendered in the case of Assistant Commissioner (CT) LTU, Kakinada and others Vs. Glaxo Smith Kline Consumer Health Care Limited, reported in (2020)19 SCC 681. Since the preliminary objection as raised strikes at the root of the maintainability of the writ petition, we feel it prudent that an opportunity should be given to the petitioner to meet the said point.
