03. I.A. No.290 of 2025

1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

2. This is an application by the Appellant for stay realization of fine.

3. Heard, Mr. Jagabandhu Sahu, learned counsel for the Appellant and Mr. R.B. Mishra, learned Addl. Public Prosecutor in the matter and perused the record.

4. Realization of fine from the Appellant under the impugned judgment in C.T. Case No. 90/29 of 2012-2013 of the Court of learned Additional District & Sessions Judge, Padampur shall remain stayed till disposal of the appeal.

5. Accordingly, the IA stands disposed of.

6. This is an application U/Ss.430(1) & (2) of Bharatiya Nagarik Suraksha Sanhita, 2023 (in short,

"BNSS") by the appellant for grant of bail pending suspension of further execution of his sentence till disposal of the appeal.

7. Heard, Mr. Jagabandhu Sahu, learned counsel for the Appellant and Mr. R.B. Mishra, learned Addl. Public Prosecutor in the matter and perused the record including the deposition of witnesses.

8. After having considered the rival submissions and on going through the evidence on record vis-à- vis the impugned judgment of conviction of the appellant and taking into account the grounds of challenge of conviction of the appellant and keeping in view the other circumstances on record in entirety, this Court is not inclined to grant bail to the appellant.

Hence, the prayer for bail and suspension of sentence of the appellant-petitioner stands rejected.

9. Accordingly, the IA stands disposed of.

10. Since LCR is already available, Office is requested to prepare paper books and supply the same to the learned counsel for the parties in accordance with Rules.

11. List this matter on 21.07.2025 for final hearing of the matter.
