01. 1. This matter is taken up through hybrid arrangement.

2. This is an application filed under Section 5 of the

Limitation Act for condoning the delay in preferring the

FAO No.134 of 2025.

3. Heard.

4. Considering the submissions and on going through the

averments made in this I.A., prayer is allowed. Delay in

preferring the FAO No.134 of 2025 is, hereby, condoned.

5. I.A. is disposed of.

6. In filing this FAO, the Appellant/Insurance Company has

challenged the judgment dated 19.11.2024 passed by the

Divisional Labour Commissioner, Jagatsinghpur in E.C. Case

6. Since Mr. Debashish Pattnaik, learned counsel has already

entered his appearance on behalf of the Respondents, let the

learned counsel for Appellant serve two spare copies of the

brief on Mr. Debashish Pattnaik, learned counsel within two

working days hence.

7. List this matter on 7th May, 2025 for final hearing.

2. Considering the submission of learned counsel for the

Appellant, this Court directs that disbursement of the

amount deposited before the learned Commissioner for

Employees' Compensation-cum-D.L.C, Jagatsinghpur in E.C.

Case No.60/2021 shall remain stayed till disposal of the FAO

No.134 of 2025.

3. This I.A. is, accordingly, disposed of.
