Learned counsel for the Petitioner submitted that being aggrieved by the conduct of the Opposite Parties particularly the Office of the Accountant General in returning the pension papers of the Petitioner with an endorsement that the same is being reserved for want of documents/ incomplete information the Petitioner has approached this Court by filing the present writ application. It is further contended that due to the inaction of the Opposite Parties, the Petitioner is deprived of him the pensionary benefits along with the grade pay which is entitled to of division of his pay scale under the RACP scheme. Learned counsel for the petitioner states that similar question had come up for consideration before a Division Bench of this Court in W.P.(C) No. 2831 of 2016 disposed of on 27.06.2016 (State of Odisha and another vrs. Bihari Lal and others), which was arising out of an order dated 12.03.2015 passed by the State Administrative Tribunal in O.A. No. 520 of 2014 and this Court quashed the order dated 21.12.2013 (wrongly mentioned as 21.12.2012 in the judgment) and held that the applicants are eligible to get financial upgradation in the posts of GPEO/PA, ABDO/SDPO and DPO on completion of 10/20/30 years of

service in the post of VLW under the RACP scheme. Therefore, the petitioner's case may be considered in the light of the said judgment.

Biharilal Barik decided by this Court in SLP Diary No.20358 of 2017 decided on 23.08.2017.

6. Considering the submissions made, this Court disposes of the writ petition at the stage of admission by directing the Principal Secretary to Government, Panchayati Raj & D.W. Department, Odisha, Bhubaneswar (Opposite Party No.1) to consider the case of the petitioner within a period of two months from the date of receipt of certified copy of this order.
