  12.               This    matter    is       taken   up   through        Hybrid

arrangement (video conferencing/physical mode).

This is an application under Section 389 of Cr.P.C. for grant of bail.

Heard.

The appellant-petitioner has been convicted under sections 120-B/121/121-A of the Indian Penal Code, sections 3 & 5 of Official Secrets Act and sentenced to undergo imprisonment for life for the offence under section 120-B of the Indian Penal Code, imprisonment

for life and to pay a fine of Rs.10,000/- (rupees ten thousand), in default of payment of fine, to further undergo R.I. for a period of one year each for the offences under sections 121/121-A of the Indian Penal Code, R.I. for a period of ten years for the offence under section 3 of the Official Secrets Act and R.I. for a period of two years for the offence under section 5 of the Official Secrets Act and all the sentences were directed to run concurrently by the learned Additional Sessions Judge, Balasore in Sessions Trial No.6/117 of 2016.

Learned counsel for the State submitted that as per the instruction dated 28.05.2024, the petitioner has got no criminal antecedent and his conduct in jail is satisfactory, which is taken on record.

After hearing the learned counsel for both the parties and perusing the impugned judgment and the materials available on record, we are not inclined to release the petitioner on bail. Accordingly, prayer for bail stands rejected.
