1. Defect No.5(e) pointed out by the S.R. is ignored as Mr. P.P.
Parida, learned counsel for the appellant undertakes to pay the High
Court Bar Association fee of Rs.50/- in course of the day.
2. This appeal has been filed by the appellant, challenging the
judgment dated 01.03.2023 passed by the learned Judge, Family
Court, Bhubaneswar in Civil Proceeding No. 423 of 2016 (In the
judgment it is mentioned as Civil Proceeding No. 423 of 2026)
allowing the petition of the husband under Section 32 of the Divorce
Act, 1869 for restitution of conjugal rights directing the appellant-
wife to join the marital society of the respondent-husband within
three months from the date of this order.
3. Mr. P.P. Parida, learned counsel for the appellant prays to
withdraw this MATA with liberty to refile with properly constituted
grounds.
4. Prayer is allowed.
5. The MATA is dismissed as withdrawn granting the liberty as
prayed for.
6. The Registry is directed to return the certified copy of the
impugned judgment to the learned counsel for the appellant after the
same is substituted by an attested photostat copy.
Issue urgent certified copy as per rules.
