04. 1. In view of the judgment of this Court in Ashis Ranjan Mohanty v.

State of Odisha (2022) 85 OCR 705, it will be open to the Petitioner to file a fresh application before the S.D.J.M., Panposh, Rourkela for release of the Ultrasound machine, which will be considered irrespective of the earlier orders dated 9th January, 2020 of the S.D.J.M., Panposh and 20th June, 2020 of the 1st Additional Sessions Judge, Rourkela in Criminal Revision No.5 of 2020.

2. Accordingly, the present petition is disposed of in the above terms.

3. The Superintendent of the concerned Branch is directed to communicate this order to the concerned Subordinate Court forthwith.
