06. 1. It is seen that by the order dated 10th January 2012 in W.P.(C) No.7811 of 2009, the writ petition was disposed of in terms of a judgment dated 2nd August 2011 in W.P.(C) No.14765 of 2009 whereby the report of the State Level Scrutiny Committee in so far as it pertains to the present Petitioner has been quashed. Consequently, the criminal case instituted on the basis of the said Committee report also cannot survive.
2. In that view of the matter, G.R. Case No.68 of 2011 and all proceedings consequent thereto are hereby quashed.
3. It is clarified that if in any de novo enquiry by the State Level Scrutiny Committee, the facts so emerge, then the present order will not prevent the institution of any fresh case against the present Petitioner.
4. The CRLMC is disposed of in the above terms. A copy of this order be sent to the concerned trial court forthwith. Issue urgent certified copy of this order as per rules.
