05. 1. The matter is taken up through Hybrid mode.

2. Heard Mr. Panigrahi, learned counsel for the Appellant and Mr. Roy, learned counsel for Respondent No.2.

3. Present appeal by the Claimant is directed against judgment dated 8th May, 2012 of 2nd M.A.C.T., Cuttack, in MAC No.712 of 1995, wherein compensation to the tune of Rs.70,000/- has been granted along with interest @6% per annum with effect from the date of filing of the claim application on account of injury sustained by the Claimant in the motor vehicular accident on 3rd March, 1995.

4. As per discharge certificates under Ext.5 series, the injured underwent treatment for the period from 3rd March, 1995 to 4th April, 1995 and 9th December, 1995 to 14th December,

1995. The operation was conducted and nailing was done in the fractured leg. Thus, considering the nature of injuries and period of treatment of the Appellant, a further consolidated sum of Rs.50,000/- is granted in favour of the Claimant. This is agreed by Mr.Nayak, learned counsel for the claimants. Mr.Das, learned counsel for the Insurer leaves it to the discretion of the Court. As such, the amount is fixed to that extent.

5. In the result, the appeal is disposed of with a direction to the Insurer to deposit the further consolidated compensation of Rs.50,000/- (fifty thousand) before the Tribunal within a period of two months from today; where-after the same shall be disbursed in favour of the claimant.

6. Urgent certified copy of this order be granted on proper application.
