        5.       1.        This matter is taken up through hybrid mode.

2. Judgment dated 19th April, 2016 passed by learned Judge, Family Court, Rourkela in Criminal Proceeding No.66 of 2013 is under challenge in this RPFAM, whereby the Petitioner has been directed to pay maintenance of Rs.3,000/- per month to the Opposite Party from the date of institution of the criminal proceeding, i.e., from 18th June, 2013.

3. Mr. Nayak, learned counsel for the Petitioner by filing a memo prays for withdrawal of the RPFAM. Memo is taken on record.

4. Accordingly, the RPFAM stands dismissed as withdrawn.

5. Interim order dated 22nd August, 2016 passed in Misc. Case No.246 of 2016 stands vacated.
