        5.       1.      This matter is taken up through hybrid mode.

2. Judgment dated 8th February, 2013 passed by learned Judge, Family Court, Khurda in Criminal Petition No.140 of 2012 is under challenge in this RPFAM, whereby the Petitioner has been directed to pay maintenance of Rs.6,000/- per month to the Opposite Party from the date of filing of the application.

3. Mr. Panda, learned counsel being authorized by Mr. Chand, learned counsel for the Petitioner submits that they have no instruction in the matter and he is also not prepared to argue the matter.

4. In that view of the matter, the RPFAM stands dismissed for non-prosecution.

5. Interim order dated 21st November, 2016 passed in Misc. Case No.355 of 2016 stands vacated.

6. Registry shall communicate this order to learned Judge, Family Court, Khurda immediately.
