03. 1. This matter is taken up through hybrid arrangement
(virtual / physical) mode.
2. The Appellant (Motilal Chhatria) by filing this
application under Section 389 of the Cr.P.C. has prayed
for suspension of execution of sentence imposed upon
him in S.T. Case No.18 of 2019 by the learned Sessions
Judge, Nuapada and his release on bail pending disposal
of this Appeal.
3. Heard.
4. Taking into account the submissions made and on
going through the impugned judgment as well as the
depositions of the prosecution witnesses and further

viewing the other surrounding circumstances, We are not
inclined to accept the prayer, as advanced in the
Application for suspension of execution of sentence and
release of the Appellant on bail pending disposal of the
Appeal.
5. The I.A. is, accordingly, dismissed.
