        3.       1.       This matter is taken up through hybrid mode.

2. None appears for the Petitioner at the time of call.

3. Judgment dated 20th November, 2013 passed by learned Judge, Family Court, Rourkela in Criminal Proceeding No.3 of 2011 is under challenge in this RPFAM, whereby the Petitioner has been directed to pay maintenance of Rs.1,500/- per month to Opposite Party No.1 and Rs.500/- per month to Opposite Party No.2 from the date of application, i.e., from 5th January, 2011.

4. On perusal of the record, it appears that there is a delay of twenty eight days in filing the RPFAM, as pointed out by the S.R..

5. Since none appears on behalf of the Petitioner to press the application (Misc. Case No.51 of 2014) for condonation of delay, the Misc. Case stands dismissed for non-prosecution. Consequently, the RPFAM stands dismissed.
