03. 1. Mrs. Panda, learned advocate appears on behalf of appellant-wife
and Ms. Jethy, learned advocate for respondent-husband.
2. Issue between the parties is regarding enhancement of permanent
alimony granted by impugned judgment dated 28th February, 2023. The
husband has filed belated appeal (MATA no.384 of 2023, tagged appeal).
Ms. Jethy submits, her client is aggrieved because he has contention in
defence to the divorce proceeding filed by the wife but was not heard.
3. Rupees 7 lakhs was directed as permanent alimony. In event, the
husband produces Demand Draft for the amount, drawn in favour of the
wife, there will arise possibility of disposal of the appeals. Parties are to

consider their respective positions. It is made clear, either way they
should come ready for hearing of the appeals on adjourned date or
whenever thereafter they are called on.
4. List on 18th December, 2023 along with the tagged appeal.
