01. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

2. Heard learned counsel for the Petitioner as well as the learned Additional Government Advocate.

3. In course of hearing of the Writ Petition, learned counsel for the Petitioner submits that his case is covered by the ratio laid down by this Court in Deepak Kumar Samal and others-v.-State of Odisha and others reported in 2022(I) ILOR-CUT 780.

4. In such view of the matter, learned counsel for the Petitioner is directed to hand over a copy of the judgment in Deepak Kumar Samal's case (supra) to the earned Additional Government Advocate, who shall obtain instruction in the matter.

5. List this matter in the week commencing from 28th August, 2023.
