58. 1. On 2nd March 2010, this appeal was heard and judgment was reserved. But, by the order dated 29th September 2011, it was posted on 9th November 2021 for final disposal. On 23rd November 2011, the matter was again listed when some additional evidence were allowed to be introduced.

2. It is gathered from the note of registry dated 23rd November 2011 that the Appellant No.1 had passed away. No steps for substitution were taken. Today, when the matter is taken up, none appears for the Appellant or the LRs.

3. Hence, the present appeal is dismissed for non-prosecution.
