ORDER
Order 10.08.2023 No. 02. 1. Mr. Satapathy, learned advocate appears on behalf of applicant
and presses for hearing and cognizance taken on contempt committed
by violation of directions made in judgment dated 9th May, 2023,
disposing of his client's writ petition.
2. Mr. Nanda, learned advocate, Additional Government
Advocate appears on behalf of alleged contemner and prays for
adjournment. He submits, writ appeal was filed on 27th May, 2023.
Several memos were thereafter filed for listing the appeal, to no avail.
On query from Court Mr. Satapathy submits, he does not have either
information or notice regarding particulars of the appeal or the papers

therein.
3. Applicant is before Court pressing for hearing. State does have
statutory right of appeal. Submission on its behalf is that it was unable
to move it till this time. There is opposition to the prayer for
adjournment. In the circumstances, this Bench is in embarrassment.
4. List on 31st August, 2023. If in the meantime alleged
contemner is not able to produce order of interference, the contempt
application is likely to be dealt with on adjourned date.
