3. Judgment dated 9th August, 2011 (Annexure-1) passed by learned Additional District Judge, Balasore in Misc. Appeal No.41/49 of 2010/2005 is under challenge in this writ petition, whereby order dated 7th February, 2005 (Annexure-6) passed by learned Additional Civil Judge (Senior Division), Balasore in Misc. Case No.438 of 2001, has been reversed.

4. Since none appears for the Petitioners to pursue the matter, this writ petition stands dismissed for non-prosecution.

5. Interim order dated 23rd December, 2011 passed in Misc. Case No.18715 of 2011 stands vacated.
