3. The present writ petition has been filed with the following prayer:-

"It is therefore prayed that, this Hon'ble Court may be graciously pleased to issue Rule NISI, in the nature of any appropriate writ/writs and/or any other writ/writs directing Opp.party No.1 to approve and release the balance price escalation amount in terms of agreement and as per the representation dated 21.4.2023 under Annexure-4 and in terms of the Judgment of this Hon'ble Court reported in the case of Raghunath Sahu v. State of Odisha, reported in AIR 2022 ORISSA 37 for the work "Construction of H.L. Bridge over Mayabati River at 2nd Km, on Sarmuhan to Sunamundi Road under RIDF 2008-09 vide agreement no.513F2 of 2008-09 under clause 32(a),

(c) & (e) of the contract."

4. In course of hearing, learned counsel for the Petitioner states that highlighting its grievance, the Petitioner has made representation to Opposite Party No.1 vide Annexure-4 and the same may be directed to be considered within a stipulated time, to which learned Counsel for the State has no objection.

5. As agreed by learned counsel for the parties and after going through the records, this Court, without expressing any opinion on the merits of the case, disposes of the Writ Petition directing Opposite Party No.1 to consider the representation filed by the petitioner vide Annexure-4, and pass appropriate order in accordance with law within a period of three months from the date of production of certified copy of this order.

Issue urgent certified copy as per Rules.
