2. Heard learned counsel for the parties.
3. Mr. P.C. Nayak, learned counsel for the petitioner states that the case of the petitioner is covered by the judgment of the apex Court in the case of State of Odisha and others v. Radheshyam Agrawal, 2023 SCC OnLine SC 331, wherein the very same clause was under consideration. Therefore, this matter may be disposed of in the light of the aforesaid judgment, to which Mr. P.P. Mohanty, learned Addl. Government Advocate appearing for the State-opposite parties has raised no objection.
4. In view of the above submission, the order dated 19.07.2021 under Annexure-1 is hereby quashed. The writ petition stands disposed of in terms of the judgment passed by the apex Court in the case of Radheshyam Agrawal (supra). The opposite parties are directed to work out the direction contained in the aforesaid judgment of the apex Court.
